"Conditions" means these terms and conditions; "Product" means a product displayed for sale on the Website; "Product Description" means that part of the Website where certain terms and conditions in respect of the individual Product are provided; "Users" means the users of the Website collectively; "Personal Information" means the details provided by you; "Website" means the website located at www.morebydesign.com or any subsequent URL which may replace it; "Cookies" means small text files which our Website places on your computer's hard drive to store information about your shopping session and to identify your computer; "United Kingdom" means England, Wales, Scotland, Northern Ireland and the Channel Islands and "You" refers to the user or viewer of this website. The use of this website is subject to the following terms of use:

  • You are provided with access to this Website in accordance with these Conditions and any orders placed by you must be placed strictly in accordance with these Conditions.

Indemnity

You agree fully to indemnify, defend and hold us, and our officers, directors, employees, agents and suppliers, harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of the Conditions by you or any other liabilities arising out of your use of this Website, or the use by any other person accessing the Website using your shopping account and/or your Personal Information.

Our rights

We reserve the right to:

  • modify or withdraw, temporarily or permanently, this Website (or any part thereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website; and/or
  • change the Conditions from time to time, and your continued use of the Website (or any part thereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any change to the Conditions then you must immediately stop using the Website.

Severance

If any part of the Conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from the Conditions and shall not affect the validity and enforceability of any of the remaining provisions of the Conditions.

No waiver by us shall be construed as a waiver of any proceeding or succeeding breach of any provision.

Survival

Each provision of the Conditions shall be construed as separately applying and surviving even if for any reason one or other of those provisions is held to be inapplicable or unenforceable in any circumstances.

Every effort is made to keep the website up and running smoothly. However, More By Design takes no responsibility for, and will not be liable for, the website being temporarily unavailable due to technical issues beyond our control.

We will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise out of or in connection with the Conditions for:

  • any economic losses (including without limitation loss of revenues, profits, contracts, business or anticipated savings); or
  • any loss of goodwill or reputation; or
  • any special or indirect losses

suffered or incurred by that party arising out of or in connection with the provisions of any matter under the Conditions.

How we use cookies

A cookie is a small file which asks permission to be placed on your computer's hard drive.   • For statistical or survey purposes to improve this Website and its services to you;
  • To serve website content and advertisements to you;
  • To administer this website;
  • If you consent, to notify you of products or special offers that may be of interest to you.

You agree that you do not object to us contacting you for any of the above purposes whether by telephone, e-mail or in writing and you confirm that you do not and will not consider any of the above as being a breach of any of your rights under the Privacy and Electronic Communications (EC Directive) Regulations 2003.

We will not sell, distribute or lease your personal information to third parties unless we have your permission or are required by law to do so. Entire agreement

These Conditions govern our relationship with you. Any changes to these Conditions must be in writing and signed by both parties. In this way, we can avoid any problems surrounding what More By Design and you are expected to do. You confirm that, in agreeing to accept the Conditions, you have not relied on any representation save insofar as the same has expressly been made a term of these Conditions and you agree that you shall have no remedy in respect of any representation.
Your Statutory Rights are not affected by these terms and conditions. Nothing in this Clause shall limit or exclude our liability in respect of any fraudulent or negligent misrepresentation whether or not such has become a term of the Conditions

This privacy policy sets out how More By Design uses and protects any information that you give More By Design when you use this website.
More By Design may change this policy from time to time by updating this page. You should check this page from time to time to ensure that you are happy with any changes. This policy is effective from 01 January 2011

What we collect

We may collect the following information:

  • billing address,
  • delivery address
  • contact information including telephone number and email address
  • demographic information such as postcode, preferences and interests
  • other information relevant to customer surveys and/or offers
  • credit card or other payment information and a password.

What we do with the information we gather

You should be aware that this site is being monitored and may capture information about your visit that will help us improve the quality of our service.

We require this information to understand your needs and provide you with a better service, and in particular for the following reasons:

  • Internal record keeping.
  • We may use the information to improve our products and services.
  • We may periodically send promotional emails about new products, special offers or other information which we think you may find interesting using the email address which you have provided. 
  • From time to time, we may also use your information to contact you for market research purposes. We may contact you by email, phone, fax or mail. We may use the information to customise the website according to your interests.

More By Design is committed to ensuring that your privacy is protected. Should we ask you to provide certain information by which you can be identified when using this website, then you can be assured that it will only be used in accordance with this privacy statement.

Orders

We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Website.

Contract creation and electronic contracting

The technical steps required to create the contract between you and us are as follows:

  • You place the order for your products on the Website by pressing the confirm order button at the end of the checkout process. You will be guided through the process of placing an order by a series of simple instructions on the Website.
  • We will send to you an order acknowledgement email detailing the products you have ordered. This is not an order confirmation or order acceptance from morebydesign.com
  • As your product is shipped from our warehouse we will send you a despatch confirmation email
  • Order acceptance and the completion of the contract between you and us will take place on the despatch to you of the Products ordered unless we have notified you that we do not accept your order, or you have cancelled it in accordance with the instructions in Change or cancel an order

Non-acceptance of an order may be a result of one of the following:

  • The product you ordered being unavailable from stock.
  • Our inability to obtain authorisation for your payment.
  • The identification of a pricing or product description error.
  • You not meeting the eligibility to order criteria set out in the main Terms & Conditions.

Buying furniture and outdoor products

  • Please check the dimensions of the delivery address for access (including doors, corridors, stairs and corners), as well as the proposed location, before you order large pieces of furniture, or outdoor products, to confirm that the product is the right size for your needs, and to enable us to deliver your order successfully.

The contract will be concluded in English.

Change or cancel an order

We’re sorry that in most circumstances it’s not possible to make changes to your order once you’ve placed it.

If you’d like to add products to your order, please place a new order for these items.

If you need to change details of your delivery address, remove items from your order or cancel it completely, please contact us for advice on 01962 734504 between 10am and 5pm Monday to Friday, or email us here. Please be ready to quote your order number and order date.

If your order has already been despatched or delivered, then you’ll need to follow our Returns procedure in the event of any unwanted products. You can also of course return them to our Alresford Store.

There are some products which we cannot cancel, refund or exchange, including made-to-measure and personalised items.

Missing, incomplete or damaged orders

If your order hasn't arrived within the expected time, or arrives incomplete, first of all please contact us for advice on 01962 734504 between 10am and 5pm Monday to Friday, or email us here.

If you have more than one item on your order, please bear in mind that products may be sent from multiple locations and so arrive separately. However, if this is not the case and you haven't received the entire order as detailed in the order confirmation email sent to you, or if your order arrives and the goods are damaged please email or call us as before.

If your item(s) arrives damaged, please notify us immediately or as soon as possible and in any event within 7 days by telephone on 01962 734504 between 10am and 5pm Monday to Friday, or email us here.

Contract cancellation under the Distance Selling Regulations

You are entitled to exercise your right to cancel this contract after your order has already been despatched, and we will refund the original purchase price and delivery charge provided you return the full order and provided that you have notified us in writing or by email no longer than 7 working days after the day on which you receive the Products and that you have taken reasonable care of the Products and not used them.

Please note that your right to return Products does NOT apply to Products which have been Made to measure or personalised in any way.

Returns Procedure:

  • Please notify us within 7 days in writing, by email, of your intention to return the goods. In addition you may wish to telephone on 01962 734504 between 10am and 5pm Monday to Friday. We will issue you with a Return Reference Number.
  • We ask that you return products to us unused, in their original packaging with any tamper seals intact.
  • Returned products (marked with the Return Reference Number) must reach us within 28 days of delivery.
  • Please enclose the returns form and Return Reference Number with the product, ensure that the product is packed securely and addressed carefully so that they are not lost or damaged in transit.
  • Goods can also be returned to our shops - however you will be required to provide us with the Return Reference Number and complete a return form before a refund or exchange is given.
  • Unless damaged in transit we do not give refunds for products which have been Made to Measure or personalised in any way.

Returning Heavy Goods

Heavy goods items can be taken away at the point of delivery free of charge. If you subsequently decide to return the products, it may take up to 28 days for collection (40 days for more remote areas) and a charge of £50 will be made.

Having notified us in writing or email, please call our customer services department on 01962 734504 to arrange returns of heavy goods. Refunds will only be given provided we receive a completed returns form.

Returning Damaged Goods

Replacements for exchange of damaged goods will not be dispatched until the original item has been received at our warehouse
We do not give refunds on the following items:

  • Items returned after 28 days.
  • Items without a Return Reference Number and completed returns form.
  • Items which do not fit into your space or for which access into your property is insufficient. It is your responsibility to measure and reassure yourself in this regard before placing your order.
  • Damaged items not notified by telephone to us within 7 days.

(This does not affect your statutory rights)

Description of Products

Each Product purchased is sold subject to its Product Description which sets out additional Specific Conditions related to that Product including, without limitation, terms and conditions concerning estimated delivery dates and times, warranties, after-sales service and guarantees.

We will take all reasonable care to ensure that all details, descriptions and prices of Products appearing on the Website are correct at the time when the relevant information was entered onto the system. Although we aim to keep the Website as up to date as possible, the information including Product Descriptions appearing on this Website at a particular time may not always reflect the position exactly at the moment you place an order. We cannot confirm the price of a Product until your order is accepted in accordance with our Order acceptance policy.

Compliance with laws

The Website may be used only for lawful purposes and in a lawful manner. You agree to comply with all applicable laws, statutes and regulations regarding the Website and any transactions conducted on or through the Website
